Stop the policing of low-income, working-class, Black and Brown bodies! Decriminalize Abortion Now!

Last September 1, 2021, the US Supreme Court upheld the “Texas Heartbeat Act” which limits the availability of abortion services to those experiencing medical emergencies and only up to the point of the first detectable cardiac activity, erroneously defined by conservatives as the first “heartbeat”. This makes abortion impossible for many, including persons who become pregnant as a result of rape, sexual abuse or incest. 

This highly regressive policy is also unprecedented in that it deputizes private citizens to sue anyone who performs an abortion or “aids and abets” – the doctor who carried out the procedure, the taxi driver who ferried the woman to the clinic, a family member or friend or organization who helped pay for the abortion – for legal fees and ten thousand dollars if they win.

This nasty vigilante system should be recognized as immensely discriminatory as it is set to disproportionately harm low-income, working-class, Black and Brown communities whose social arrangements facilitate access to safe abortion services for people who rely on local clinics to provide the life-saving procedure.

Again, we reiterate that criminalizing abortion does not stop abortions from happening but drives already marginalized people into resorting to unsafe abortion practices that can cause complications and may be fatal.  

WGNRR stands in solidarity with the people of Texas in their demands to repeal the near-total abortion ban which violates their basic human rights to health, privacy, and bodily autonomy.

The move towards greater policing and punishment in Texas is in sharp contrast to advances across the border where a unanimous decision by Mexico’s Supreme Court has ruled that it is “unconstitutional” to punish abortion as a crime. We celebrate with activists in Mexico that have fought long and hard for recognition of their rights and are continuing to mobilize towards full decriminalization in the country.

We reiterate our call to all governments around the world to end the criminalization of abortion and to remove laws and policies that restrict access to safe abortion.

去る2021年9月1日、米国最高裁判所は「テキサス・ハートビート法」を支持しました。この法律は、中絶サービスを受けることができるのは、医療上の緊急事態が発生した場合に限られ、保守派が誤って定義した最初の「心拍」と呼ばれる心活動が検出された時点までとしています。これにより、レイプ、性的虐待、近親姦などの結果として妊娠した人を含む多くの人が中絶できなくなります。

この非常に退嬰的な政策は、中絶を行った医師、女性をクリニックに連れて行ったタクシー運転手、中絶費用を援助した家族や友人、団体など、中絶を行った者や「幇助」した者を、弁護士費用と勝訴した場合の1万ドルで民間人が告訴できるという点でも前例のないものです。

このような悪質な自警団システムは、低所得者層、労働者層、黒人や褐色のコミュニティに大きな差別的影響を与えるものであると認識すべきです。

繰り返しになりますが、中絶を犯罪化することは中絶を止めることにはならず、すでに社会から疎外されている人々を、合併症を引き起こし致命的になる可能性のある安全でない中絶行為に頼らせることになります。

WGNRRは、健康、プライバシー、身体的自律性という基本的人権を侵害する、ほぼ全面的な中絶禁止令を撤廃するよう要求するテキサス州の人々と連帯します。

テキサス州における取り締まりと処罰の強化の動きは、国境を越えた動きとは対照的です。メキシコの最高裁判所が満場一致で、中絶を犯罪として処罰することは「違憲」であるという判決を下しました。私たちは、自分たちの権利を認めてもらうために長く懸命に戦い、国内での完全な非犯罪化に向けて動員を続けているメキシコの活動家たちを祝福します。

私たちは、世界中のすべての政府に対して、中絶の犯罪化を廃止し、安全な中絶へのアクセスを制限する法律や政策を撤廃するよう、改めて呼びかけます。
